No. 6. The defendant Shokichi in conspiracy with

Hikokichi Abe, and notwithstanding that he had obtained

no permit from the Home Minister shipped 28 tins (each

containing 700 grammes) of anaesthetic diacetyle morphone

hydrochloride on several occasions from about January 3rd,

1938, to the end of July 1938, through the hands of

Hikokichi Abe and Saichiro Okawa, on the s.s. "Nagasaki Maru"

at Nagasaki, and exported them to Shanghai.

No. 7.

The defendant Shinichi Masuda;

(1) In selling anaesthetics to Shokichi Kurusu

knew that he was about to export anaesthetics to Shanghai,

without having obtained a permit from the Home Minister,

and sold 28 tins (each containing 700 grammes) of anaesthetic

diacetyle morphine hydrochloride to the same person at his

own residence at No.4, 5-chome, Waritsuka-dori, Fukiaiku,

Kobe, on eight occasions during the period from about

December 24th, 1937 to July 9th, 1938, thereby assisting

and facilitating the commission of offences by the same

person as stated in No.6.

Notwithstanding the fact that he was not a

pharmacist and not qualified to sell "specified" medicines,

sold 72 tins (each containing 700 grammes), 10 bottles

(each containing 25 grammes), and 1,546 bottles (each

containing 5 grammes) diacetyle morphine hydrochloride,

38 tins (each containing 450 grammes) of morphine hydro-

chloride, 22 tins (each containing 700 grammes), and 6

bottles (each containing 5 grammes) of cocaine hydrochloride

to Rinnosuke Kudo, Yasuichiro Hattori, Yoshitaro Isono,

Chen-wen-pin, and Heizo Nakamura at their own residences on

scores of occasions during the period from about December

3rd, 1937, to July 21st, 1938.
